AGREEMENT ____ THIS AGREEMENT, made and entered into at Los Angeles, California, upon this 15th day of June, 1934, by and between NANCY C. RUSSELL, hereinafter referred to as the party of the first part, and F. E. Keeler, doing business under the name of KEELER ART BRONZE WORKS and CALIFORNIA ART BRONZE FOUNDRY, hereinafter referred to as the party of the second part, WITNESSETH: WHEREAS, the party of the first part is the owner of certain models from which certain castings or reproductions have been made by the party of the second part; and WHEREAS, differences of opinion have arisen as to the right and authority of the party of the second part to so make such models, statuettes or reproductions; and WHEREAS, it is the desire of both parties to settle their differences amicably: NOW, THEREFORE, in consideration of the premises it is understood and agreed as follows: That the party of the second part shall return and deliver to the party of the first part without compensation, except as herein recited – 8- Charlie Russell ash trays 3- Rearing horse, standing on its hind legs 1- Bucking horse, standing on its head 4- Larger bucking horse, making a total of eight ash trays and eight statuettes. That upon the delivery by the party of the second part to the party of the first part of said articles and the giving of receipt therefor[sic] by said party of the first part, each of the parties shall, and each of said parties does hereby release the other from any and all claims and demands of every kind and nature whatsoever. It is hereby represented that Ben S. Hunter, who will sign this agree- ment on behalf of the party of the second part, has been the attorney for the party of the second part for a period of over ten years, and that this agreement is signed by him in lieu of his client in accordance with the custom usually followed in such matters. The Homer and Helen Britzman collection consists of over 10,000 objects belonging to Charles M. Russell including letters, drawings, personal belongings, photos, and other memorabilia. Homer Britzman worked extensively with Charles Russell’s wife, Nancy, to write Russell’s biography. Chain of custody: Nancy Russell, Homer and Helen Britzman, Colorado Springs Fine Arts Center, Amon Carter (inventoried collection in 1997), Gilcrease Management Trust (will become property of TU Special Collections if management agreement between TU and the City of Tulsa is severed).
